Laser Safety Supplies Australia. ABN [ABN]. Last updated: [date].

1. About these terms

1.1 These Terms and Conditions of Sale ("Terms") apply to every order placed with Laser Safety Supplies Australia, ABN [ABN] ("we", "us", "our"), through our website, by email, by phone or by any other means.

1.2 By placing an order, you agree to these Terms. If you place an order on behalf of a business or organisation, you confirm that you are authorised to accept these Terms on its behalf.

1.3 These Terms should be read with our Privacy Policy and any product-specific information, instructions or warranty documents supplied with a product.

1.4 Nothing in these Terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified (see section 13).

2. Definitions

In these Terms:

  • Australian Consumer Law means Schedule 2 to the Competition and Consumer Act 2010 (Cth).
  • Customer or you means the person or organisation placing an order with us.
  • Products means the goods we sell, including laser safety eyewear, IPL safety eyewear, laser safety signs and related accessories.
  • Eyewear means laser safety glasses, goggles, IPL eyewear and any other protective eyewear we sell.
  • Order means a request to buy Products, however made.

3. Who may buy

3.1 Our Products are supplied for use in workplaces by persons conducting a business or undertaking (PCBUs), employers and their workers, and by qualified professionals.

3.2 You must be at least 18 years old to place an order.

3.3 We supply Products for delivery within Australia only, unless we agree otherwise in writing.

3.4 We may decline any order, including where we reasonably believe the Products are unsuitable for the intended use, or are intended for an unlawful or unsafe purpose.

4. Choosing the right product is your responsibility

4.1 Laser and IPL safety eyewear protects only against the wavelengths, optical density and exposure conditions it is rated for. Eyewear that is suitable for one device may give no protection against another.

4.2 You are responsible for selecting Products that are suitable for your equipment, your workplace and your intended use. Before ordering, you must check:

  • the wavelength or wavelengths emitted by each laser or IPL device
  • the output power or energy, and whether the device is continuous wave or pulsed
  • the optical density and protection markings required, as specified by the device manufacturer, your laser safety officer or another suitably qualified person
  • that the Eyewear fits each wearer and is compatible with any other protective equipment they use

4.3 Under work health and safety laws, the PCBU remains responsible for assessing laser risks and providing suitable personal protective equipment. Personal protective equipment is the last line of defence and does not replace other controls, such as engineering controls, controlled areas, procedures and training.

4.4 We may provide general information to help you choose a Product. Any such information is a guide only and is based on the details you give us. It is not a risk assessment and does not replace the advice of the device manufacturer, your laser safety officer or another suitably qualified person. You must check that the markings on any Eyewear match the parameters of your device before use.

4.5 If you are unsure whether a Product is suitable, do not use it until you have confirmed its suitability.

5. Product information and certification

5.1 We source Products only from suppliers who provide certification to recognised standards, and we review that documentation before adding a Product to our range. Certification documents are prepared by the manufacturer or an independent testing body, not by us. We rely on them in good faith.

5.2 Product descriptions, specifications, protection ratings and certification details on our website are based on information supplied by the manufacturer. We take reasonable care to present this information accurately, but manufacturers may change specifications, packaging or markings without notice.

5.3 The markings on the Product and the documents supplied with it take priority over the description on our website. If there is any difference, contact us before using the Product.

5.4 Images are for illustration only. Colours, tints and appearance may differ from the actual Product.

5.5 Copies of available certification documents can be requested by contacting us.

6. Safe use, care and inspection

6.1 You must use, store, clean and maintain Products in accordance with the manufacturer's instructions.

6.2 Eyewear should be inspected before each use. Do not use Eyewear that is scratched, cracked, discoloured, deformed or otherwise damaged, or whose markings cannot be read.

6.3 Laser safety eyewear is designed to protect against accidental exposure, not to be used for deliberately viewing a beam. Eyewear that has been struck by a direct beam, or exposed to radiation above its rated limits, may be damaged even if no damage is visible and should be replaced.

6.4 Do not modify Products, including by fitting non-approved lenses, frames, filters or coatings. A modified Product may no longer give the protection it was certified for.

6.5 You are responsible for ensuring that workers and other people who use the Products are trained in their correct selection, fit, use, inspection and storage.

7. Orders

7.1 An Order is an offer to buy Products. An Order is accepted when we confirm it in writing or dispatch the Products, whichever comes first.

7.2 We may refuse or cancel an Order before dispatch, including where a Product is unavailable, where there is an obvious error in pricing or product information, or under section 3.4. If we cancel an Order you have paid for, we will refund the amount paid.

7.3 You may cancel an Order before it is dispatched by contacting us. Custom or made-to-order Products, including personalised signs, cannot be cancelled once production has started, except as required by law.

8. Pricing

8.1 Prices are in Australian dollars and include GST unless stated otherwise.

8.2 Delivery charges are shown before you confirm your Order.

8.3 Prices may change at any time, but a change will not affect an Order we have already accepted.

8.4 If a Product is listed at an obviously incorrect price because of a typographical or system error, we may cancel the Order and refund any payment, even after acceptance.

9. Payment

9.1 Payment must be made in full before dispatch, unless we have agreed account terms with you in writing.

9.2 Payments are processed by our third-party payment providers. We do not see or store your full card details.

9.3 Where we agree account terms, invoices are payable within the period stated on the invoice. We may suspend further supply while any amount is overdue.

10. Delivery

10.1 We deliver to addresses within Australia using third-party couriers and postal services.

10.2 Delivery times are estimates only. We are not responsible for delays caused by couriers, weather, or other events outside our reasonable control, but we will help you follow up a delayed delivery.

10.3 You must provide a complete and accurate delivery address. If a delivery fails because of an incorrect address or because no one was available to receive it, you may need to pay for redelivery.

10.4 Please inspect Products on delivery and tell us within [7] days if a Product is damaged, faulty, incorrect or missing. Keep the packaging until the matter is resolved.

11. Title and risk

11.1 Risk of loss or damage passes to you on delivery.

11.2 Ownership of the Products passes to you when we receive payment in full.

12. Returns and refunds for change of mind

12.1 We accept returns for change of mind within [30] days of delivery, provided the Product is:

  • unused, unworn and in its original, undamaged and, where applicable, sealed packaging
  • returned with all accessories, documentation and proof of purchase

12.2 Because Eyewear is personal protective equipment, we cannot accept change-of-mind returns of Eyewear that has been worn, removed from protective film or sealed packaging, or otherwise used.

12.3 Custom or made-to-order Products, including personalised signs, cannot be returned for change of mind.

12.4 For change-of-mind returns, you pay the cost of return shipping, and we refund the price of the Product (excluding original delivery charges) once we have received and inspected it.

12.5 To arrange a return, contact us first so we can give you return instructions.

12.6 This section does not limit your rights under the Australian Consumer Law. If a Product is faulty, not as described or not of acceptable quality, section 13 applies.

13. Australian Consumer Law

13.1 Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

13.2 If you believe a Product has a problem covered by the consumer guarantees, contact us with your order details, a description of the problem and, where possible, photographs. We may ask you to return the Product for assessment. If the claim is accepted, we will cover reasonable return shipping costs.

13.3 The consumer guarantees do not apply where a Product has been damaged by misuse, accident, abnormal use, failure to follow the manufacturer's instructions, modification or normal wear and tear, or where you simply changed your mind (see section 12).

13.4 Where you acquire Products as a business and the Products are not of a kind ordinarily acquired for personal, domestic or household use, our liability for a failure to comply with a consumer guarantee (other than a guarantee under sections 51, 52 or 53 of the Australian Consumer Law) is limited, to the extent permitted by section 64A of the Australian Consumer Law, to one of the following, at our option:

  • replacing the Products or supplying equivalent Products
  • repairing the Products
  • paying the cost of replacing the Products or acquiring equivalent Products
  • paying the cost of having the Products repaired

14. Manufacturer warranties and recalls

14.1 Some Products come with a manufacturer's warranty. Any such warranty is provided by the manufacturer, is in addition to your rights under the Australian Consumer Law, and is subject to the manufacturer's own terms. We will pass on any manufacturer's warranty to you and help you make a claim.

14.2 If a manufacturer or regulator issues a recall or safety notice for a Product we have supplied, we will take reasonable steps to notify affected customers using the contact details we hold. Please keep your contact details up to date and follow any recall instructions promptly.

15. Safety signs

15.1 Our signs are designed to communicate laser hazards using recognised safety colours and symbols. Unless a Product description expressly states otherwise, we do not represent that a sign satisfies every requirement of a particular Australian Standard, regulator or jurisdiction.

15.2 You are responsible for deciding which signs your workplace needs, where they are placed, and for checking any signage requirements that apply in your state or territory.

15.3 For illuminated signs, you are responsible for correct installation, including any electrical work, which must be carried out by a licensed electrician where required by law, and for ensuring the sign is connected and operating as intended.

15.4 For custom signs, you are responsible for checking and approving the proof, including all wording, before production. We are not responsible for errors in wording you have approved.

16. Limitation of liability

16.1 Nothing in this section excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition implied or imposed by the Australian Consumer Law or any other law, that cannot lawfully be excluded or limited.

16.2 Subject to section 16.1 and to the extent permitted by law:

  • we are not liable for any loss, damage or injury to the extent it is caused or contributed to by: the selection of a Product that is unsuitable for your equipment or use; use of a Product outside its rated specifications or the manufacturer's instructions; failure to inspect, maintain or replace a Product; modification of a Product; or failure to implement other appropriate laser safety controls
  • we are not liable for any indirect or consequential loss, including loss of profit, revenue, business, opportunity, data or goodwill
  • our total liability to you arising out of or in connection with an Order, whether in contract, tort (including negligence), under statute or otherwise, is limited to the amount you paid for the Products that gave rise to the claim

16.3 Each limitation in this section applies only to the extent it is not prohibited by law and does not limit liability that cannot be limited, including liability arising under Part 3-5 of the Australian Consumer Law.

17. Indemnity

To the extent permitted by law, you indemnify us against any claim, loss, liability or reasonable cost (including legal costs) brought by a third party against us, to the extent it arises from your breach of these Terms, your negligence, or your misuse or modification of a Product. Your obligation under this section is reduced to the extent that the claim, loss or liability was caused by our own breach, negligence or wilful misconduct.

18. Information is not advice

18.1 Information on our website, in our product descriptions, and in any communication with us is general information only. It is not legal, medical, clinical or professional advice, and it is not a risk assessment of your workplace.

18.2 Laser Safety Compliance Australia is a separate educational resource founded by the same person. Its content is general information only, and these Terms do not make it a party to any sale.

19. Privacy

We handle your personal information in accordance with our Privacy Policy, available on our website.

20. Intellectual property

All content on our website, including text, images, logos and designs, is owned by us or used under licence. You may not copy, reproduce or use it for commercial purposes without our prior written consent. Manufacturer names and trade marks belong to their respective owners.

21. Events outside our control

We are not liable for any delay or failure to perform our obligations caused by events outside our reasonable control, including supplier shortages, transport disruptions, natural disasters, pandemics, industrial action or government action. We will tell you as soon as practicable and, if an Order cannot be filled, refund any amount you have paid for undelivered Products.

22. Complaints and disputes

22.1 If you have a complaint, please contact us first. We will acknowledge it promptly and aim to resolve it within [14] days.

22.2 If a dispute cannot be resolved between us within 30 days, either party may refer it to mediation before commencing court proceedings, except where urgent relief is needed. This does not limit your right to contact a consumer protection agency, such as Consumer Affairs Victoria or the equivalent agency in your state or territory.

23. Governing law

These Terms are governed by the laws of Victoria, Australia. Each party submits to the non-exclusive jurisdiction of the courts of Victoria and courts that may hear appeals from them.

24. Changes to these Terms

We may update these Terms from time to time. The version published on our website when you place an Order applies to that Order.

25. General

25.1 If any part of these Terms is invalid or unenforceable, it will be read down or severed to the extent necessary, and the rest of these Terms will continue to apply.

25.2 A failure or delay by us in exercising a right does not waive that right.

25.3 These Terms, together with our Privacy Policy and any written agreement we make with you about an Order, form the entire agreement between us about that Order.
